The Musings Project is an editorial photography publication and creative platform created by photographer Nick Johnson.

The website may feature photography, video, written articles, interviews, educational materials, subscription content, digital content, physical products, and other creative works.

Derivative Works and Artificial Intelligence Use

 

No content from The Musings Project may be used to create derivative works without prior written permission.

Prohibited derivative works include, but are not limited to:

  • Paintings based upon photographs

  • Drawings based upon photographs

  • Digital illustrations based upon photographs

  • Composite artwork incorporating photographs

  • Photo manipulations derived from photographs

  • Traced reproductions

  • Filters, stylizations, or artistic transformations

  • AI-generated images, videos, avatars, digital replicas, synthetic media, or other machine-generated works created from, trained upon, referenced from, prompted from, adapted from, or substantially derived from content published by The Musings Project

Creating a new artistic medium from an existing photograph does not create new ownership rights in the underlying image.

No person may claim copyright ownership, authorship, or originality over derivative works based upon content from The Musings Project without written authorization.

The Musings Project expressly reserves all rights related to derivative works, adaptations, reproductions, machine-learning uses, dataset creation, AI training, AI fine-tuning, image-to-image generation, digital replication, synthetic media creation, and similar technologies.

Right of Publicity and Model Protection

The individuals depicted in photographs, videos, and other content published by The Musings Project retain legal rights related to their name, likeness, image, identity, and personal publicity.

Except where expressly authorized in writing, users may not use any photograph, video, or likeness appearing on this website for:

  • Commercial advertising or promotion

  • Product endorsements

  • Marketing materials

  • Social media impersonation

  • Fake accounts or profiles

  • Dating profiles

  • Catfishing or deceptive online activity

  • Deepfakes or synthetic media

  • AI companions, virtual influencers, or chatbot personas

  • Training, fine-tuning, or generating artificial intelligence systems intended to replicate or simulate a person's appearance, voice, identity, or likeness

  • Any use that could reasonably imply endorsement, affiliation, sponsorship, participation, or approval by the individual depicted

No photograph, video, or likeness appearing on The Musings Project may be used to create digital replicas, synthetic representations, virtual characters, or other technologies intended to imitate, reproduce, or simulate the appearance or identity of any featured individual without prior written authorization from both The Musings Project and, where applicable, the individual depicted.

Unauthorized use of a person's likeness may violate rights of publicity, privacy laws, intellectual property laws, and other applicable legal protections.

The Musings Project reserves the right to pursue removal requests, account termination, DMCA remedies where applicable, and any other legal remedies available under law to protect the rights of both the creator and the individuals featured in the work.

Limited Sharing Permission

We appreciate members who help share and support the project.

Users may:

  • Share links to publicly accessible pages

  • Repost officially published promotional materials with attribution

  • Discuss and review content

Users may not redistribute subscriber-only content, downloadable materials, full-resolution files, videos, or member-exclusive content without written permission.

Membership Access

Certain portions of the website may be restricted to subscribers or members.

Membership access is licensed to a single individual and may not be shared with others.

The Musings Project reserves the right to suspend or terminate access for users who:

  • Share account credentials

  • Redistribute member content

  • Violate these Terms of Service

Subscription Billing

Where subscriptions are offered directly through this website:

  • Memberships renew automatically unless canceled.

  • Subscribers may cancel at any time.

  • Cancellation prevents future billing but does not automatically generate refunds for previous charges.

  • Access remains active through the end of the current billing period.

Membership offerings, pricing, benefits, and content schedules may be modified at any time.

The Musings Project may choose to grandfather existing members into legacy pricing or benefits at its sole discretion.

No Right to Ongoing Access

The Musings Project may add, modify, archive, remove, discontinue, or reorganize content, features, products, membership tiers, publications, and services at any time.

A subscription grants access to content made available during an active membership period but does not create ownership rights or guarantee permanent access to any specific content, feature, archive, publication, product, or service.

Physical Products

The Musings Project may offer physical products including:

  • Collectibles

  • Merchandise

Product photographs are representative.

Actual products may vary slightly due to printing processes, materials, monitor calibration, manufacturing differences, packaging updates, or other production variables.

Edition sizes, availability, and product specifications are determined solely by The Musings Project.

Returns and Refunds

Digital products, downloads, memberships, and subscription fees are non-refundable except where required by law.

Physical products may be eligible for replacement if damaged during shipment or delivered incorrectly.

Customers must report shipping damage within seven (7) days of delivery and may be required to provide photographic documentation.

The Musings Project reserves the right to determine appropriate remedies on a case-by-case basis.

Unauthorized Distribution

The Musings Project actively protects its intellectual property.

Unauthorized reproduction, redistribution, publication, reposting, commercial exploitation, derivative creation, AI training use, synthetic media creation, or other infringement may result in:

  • Account termination

  • Revocation of access

  • DMCA takedown notices

  • Requests for removal

  • Legal action

  • Recovery of damages where permitted by law

  • Any other remedies available under applicable law

User Conduct

You agree not to:

  • Attempt unauthorized access to systems, accounts, or services

  • Circumvent security measures

  • Scrape, harvest, or systematically collect website content

  • Harvest user information

  • Introduce malicious software or code

  • Engage in harassment, threats, or abusive behavior

  • Impersonate another individual or entity

  • Use the website for unlawful purposes
